PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Braxton Davis, Director, Division of Marine Fisheries, upon the recommendation of Randall Williams, M.D., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Wednesday, October 5, 2016.

All those waters in New Hanover and Carteret Counties will return to the status in existence immediately prior to the September 3, September 13, September 20, and September 23, 2016, temporary closures except the following which remains closed:

CARTERET COUNTY

White Oak River - All those waters in the White Oak River north of a line beginning at a point 34° 41.9497' N -77° 06.9846' W on the west shore, running easterly near the northern tip of Jones Island, to a point 34° 41.9395'N -77°05.6599'W on the east shore.

Newport River - All those waters upstream of a line across the river from Crab Point to the southern end of the west shore of Core Creek.

The following also remains closed:

BRUNSWICK / PENDER / ONSLOW / HYDE COUNTIES

All those waters between IWW Beacon "84" and the South Carolina Line, to include the Tubbs Inlet area.

All those waters between IWW Fl. Beacon “51A” near the Holden Beach Bridge and IWW Fl. Beacon “71A” near Long Point.

All those waters bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of the New River Inlet), and bordered on the southwest by a line beginning at a point on the mainland at Forest Sound Marina, running southerly through Beacon “98A”, and following the eastern shore of Black Mud Channel to the southern tip of Topsail Beach, to include Old Topsail Creek, Virginia Creek, Topsail Sound, Stump Sound, Alligator Bay, and Chadwick Bay.

All those waters, from the IWW to the mainland, between IWW Beacon “47”, near Swansboro, and the Turn Marker at Cow Channel, to include Queens Creek.

White Oak River - All those waters in the White Oak River north of a line beginning at a point 34° 41.9497' N -77° 06.9846' W on the west shore, running easterly near the northern tip of Jones Island, to a point 34° 41.9395'N -77°05.6599'W on the east shore.

All those waters in Germantown Bay upstream of a line beginning at Spencer Point, running southeasterly to Short Point.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C.  In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. This proclamation returns the following area to normal closure boundaries: Middle Sound, a portion of Newport River, Jarrett Bay, and Oyster Creek.

E. These reopenings are due to satisfactory bacteriological sampling results.
