PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Braxton Davis, Director, Division of Marine Fisheries, upon the recommendation of Randall Williams, M.D., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Wednesday, September 28, 2016.

All those waters in Onslow, Carteret and Pamlico Counties will return to the status in existence immediately prior to the September 3, September 13, and September 20, 2016, temporary closures except the following which remains closed:

ONSLOW / CARTERET / PAMLICO COUNTIES

All those waters bordered on the northeast by the North Topsail Beach High-rise Bridge; and bordered on the southwest by the Figure 8 Island Bridge.

Freeman Creek – All those waters in Freeman Creek upstream of a straight line across the mouth.

All those waters, Intracoastal Waterway to the mainland between IWW Beacon “36”, near Goose Creek in Carteret County, and IWW Fl. Beacon “55”, near Sanders Creek (Onslow County), to include Goose Creek, Hunting Island Bay, Deer Creek, White Oak River, and Queens Creek.

Newport River - All those waters
in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.

Whitehurst Creek - All those waters in Whitehurst Creek upstream of a straight line across the mouth.

Sleepy Creek - All those waters in Sleepy Creek upstream of a straight line across the mouth.

Jarrett Bay - All those waters in Jarrett Bay upstream of a line beginning at a point on the east shore of Spit Bay; thence in a straight line to the northern tip of Davis Island; then in a straight line to the "Chimney" near Jump Run Creek.

Oyster Creek - All those waters in Oyster Creek upstream of a straight line across the mouth.

All those waters in Neuse River south and west of a line running from Deep Point to Point of Marsh, to include the Neuse River, Adams Creek, South River, Turnagain Bay, and Broad Creek (Pamlico County).

The following also remains closed:

BRUNSWICK / NEW HANOVER / PENDER / CRAVEN / HYDE COUNTIES

All those waters between IWW Beacon "84" and the South Carolina Line, to include the Tubbs Inlet area.

All those waters between IWW Fl. Beacon “51A” near the Holden Beach Bridge and IWW Fl. Beacon “71A” near Long Point.

All those waters in Myrtle Grove Sound bordered on the north by a straight line beginning at a point 34° 07.796’N – 77° 52.072’W near Peden Point; running easterly through Intracoastal Waterway Beacon “141” and US Army Corps of Engineers Spoils Island #261 to a point 34° 07.459’N – 77° 51.071’W on Masonboro Island; and bordered on the south by Snows Cut.

All those waters, Intracoastal Waterway to the mainland, between the Figure 8 Island Bridge and IWW Beacon “141”, near Peden Point.

All those waters in Neuse River south and west of a line running from Deep Point to Point of Marsh, to include the Neuse River, Adams Creek, South River, Turnagain Bay, and Broad Creek (Pamlico County).

All those waters in Germantown Bay upstream of a line beginning at Spencer Point, running southeasterly to Short Point.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C.  In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. This proclamation returns the following areas to normal closure boundaries: Alligator Bay, Chadwick Bay, North River, Ward Creek, a portion of Jarrett Bay, Brett Bay, Nelson Bay, Bay River, Jones Bay, Oyster Creek (Pamlico County), James Creek, Middle Prong, and Clark Creek.

E. These reopenings are due to satisfactory bacteriological sampling results.
