PROCLAMATION

RE: SHELLFISH POLLUTED AREA┬┐


Stephen W. Murphey, Director, Division of Marine Fisheries, upon the recommendation of Betsey Tilson, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Friday, October 19, 2018.

All those waters in Onslow and Pamlico Counties will return to the status in existence immediately prior to the September 13, 2018, temporary closures except the following which will remain closed:

ONSLOW / PAMLICO COUNTIES

All those waters, from the Intracoastal Waterway to the mainland, between IWW Marker “49” (34° 40.2621’N - 77° 07.9802’ W) near Swansboro and IWW Beacon “55” (34° 38.5749’N - 77° 10.8033’ W) near Goose Creek, to include Queens Creek.

Bay River - All those waters
bordered on the north by a line running across the Intracoastal Waterway from a point 35° 13.2876' N - 76° 35.5883' W to a point 35° 13.2846' N - 76° 35.4993' W; and bordered on the south by a line beginning at a point 35° 11.8658' N - 76° 34.1288' W, running southwesterly through Beacon “27” to a point 35° 11.3152' N - 76° 35.9773' W near Sanders Point, to include Bear Creek, Chadwick Creek, and Gale Creek.

The following also remains closed:


BRUNSWICK / NEW HANOVER / CARTERET COUNTIES

Shallotte River – All those waters in Shallotte River
upstream of a line beginning at a point 33° 55.3874’ N - 78° 22.2861’ W on the western shore of the Shallotte River approximately 650 yards south of The Swash; running easterly to a point 33° 55.3385’ N - 78° 21.7279’ W on the eastern shore of the Shallotte River approximately 650 yards south of Shallotte Creek.

All those waters bordered on the northeast by the Figure Eight Island Bridge; and bordered on the southwest by IWW Beacon “1”, near Southport, to include Cape Fear River, Bald Head Island, Myrtle Grove Sound, Masonboro Sound, and a portion of Middle Sound.

Bogue Sound - All those waters in Bogue Sound bordered on the east by the Atlantic Beach Bridge; and bordered on the west by a line beginning at a point 34° 42.0590' N - 76° 59.2109' W on the mainland, running southeasterly near IWW Beacon “33” and the eastern tip of Long Island to a point on Emerald Isle at 34° 40.6066' N - 76° 58.4894' W.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C.  In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. This proclamation returns the following areas to normal closure boundaries: New River and Neuse River.

E. These reopenings are due to satisfactory bacteriological sampling results.
