PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Stephen W. Murphey, Director, Division of Marine Fisheries, upon the recommendation of Betsey Tilson, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Wednesday, October 17, 2018.

All those waters in Brunswick and Carteret Counties will return to the status in existence immediately prior to the September 13, 2018, temporary closures except the following which will remain closed.

BRUNSWICK / CARTERET COUNTIES

Shallotte River – All those waters in Shallotte River upstream of a line beginning at a point 33° 55.3874’ N - 78° 22.2861’ W on the western shore of the Shallotte River approximately 650 yards south of The Swash; running easterly to a point 33° 55.3385’ N - 78° 21.7279’ W on the eastern shore of the Shallotte River approximately 650 yards south of Shallotte Creek.

All those waters bordered on the northeast by the Figure Eight Island Bridge; and bordered on the southwest by IWW Beacon “1”, near Southport, to include Cape Fear River, Bald Head Island, Myrtle Grove Sound, Masonboro Sound, and a portion of Middle Sound.

All those waters, from the Intracoastal Waterway to the mainland
, between IWW Marker “45A” (34° 40.3904’N - 77° 05.9365’ W) near Cedar Point and IWW Beacon “55” (34° 38.5749’N - 77° 10.8033’ W) near Goose Creek, to include Queens Creek and White Oak River.

Bogue Sound - All those waters in Bogue Sound bordered on the east by the Emerald Isle Bridge and bordered on the west by a line beginning at a point 34°40.4490’N - 77°05.9501’ W on the mainland, running southerly near Marker “45A” and following the eastern shore of Coast Guard Channel near Beacon “5” to a point 34°39.1597’N - 77°05.7070’ W along the Coast Guard Channel on Emerald Isle.

Bogue Sound - All those waters in Bogue Sound bordered on the east by the Atlantic Beach Bridge; and bordered on the west by a line beginning at a point 34° 42.0590' N - 76° 59.2109' W on the mainland, running southeasterly near IWW Beacon “33” and the eastern tip of Long Island to a point on Emerald Isle at 34° 40.6066' N - 76° 58.4894' W;

Bogue Sound – All those waters from the Intracoastal Waterway to the mainland in Bogue Sound between the permanent closure line near 16th Street in Morehead City and the Atlantic Beach Bridge.

Newport River - All those waters in Newport River
upstream of a line beginning at a point on the south shore at 34° 45.7044' N -76° 43.4977' W near Penn Point; running northerly to a point on the west shore of Harlowe Creek at 34° 46.6935' N -76° 43.4719' W.

The following also remains closed:

NEW HANOVER / ONSLOW / PAMLICO COUNTIES

All those waters bordered on the northeast by the Figure Eight Island Bridge; and bordered on the southwest by IWW Beacon “1”, near Southport, to include Cape Fear River, Bald Head Island, Myrtle Grove Sound, Masonboro Sound, and a portion of Middle Sound.

All those waters in New River upstream of the Highway 172 Bridge.

All those waters, from the Intracoastal Waterway to the mainland, between IWW Marker “45A” (34° 40.3904’N - 77° 05.9365’ W) near Cedar Point and IWW Beacon “55” (34° 38.5749’N - 77° 10.8033’ W) near Goose Creek, to include Queens Creek and White Oak River.

All those waters in Neuse River bordered by a line beginning at Maw Point, running southeasterly to Fl. Beacon “NR”; thence running southwesterly to a point 34° 58.3128' N - 76° 43.7327' W in the Neuse River, thence running northwesterly to a point 34° 59.5689' N - 76° 45.3295' W on the shoreline near Dawson Creek, to include Broad Creek.

Bay River - All those waters bordered on the north by a line running across the Intracoastal Waterway from a point 35° 13.2876' N - 76° 35.5883' W to a point 35° 13.2846' N - 76° 35.4993' W; and bordered on the south by a line beginning at a point 35° 11.8658' N - 76° 34.1288' W, running southwesterly through Beacon “27” to a point 35° 11.3152' N - 76° 35.9773' W near Sanders Point, to include Bear Creek, Chadwick Creek, and Gale Creek.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. This proclamation returns the following areas to normal closure boundaries: Tubbs Inlet, a portion of Shallotte River, Lockwoods Folly River, a portion of Bogue Sound, Tar Landing Bay, and a portion of Newport River.

E. These reopenings are due to satisfactory bacteriological sampling results.
