PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Megan Davies, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Wednesday, October 21, 2015.

All those waters in New Hanover, Pender, Onslow, and Carteret Counties will return to the status in existence immediately prior to the September 25, September 28, and October 2, 2015, temporary closures except the following which will remain closed:

NEW HANOVER / ONSLOW / CARTERET COUNTIES

All those waters between the permanent closure line at Snows Cut and IWW Beacon “32” near Lockwoods Folly River, to include Cape Fear River.

All those waters between IWW Marker “37”, near Everett Bay, and IWW Marker “49”, near Morris Landing.

Back Sound – All those waters between the permanent closure line at Fort Macon and a line running from Channel Marker #56B southwesterly to the Rock Jetty on Shackleford Banks.

The following also remains closed:

BRUNSWICK / PAMLICO / HYDE / DARE COUNTIES

All those waters between Beacon "89", near Ocean Isle, and the South Carolina State Line, to include the Tubbs Inlet area.

All those waters in the Intracoastal Waterway at Holden Beach between Beacon “71”, near Shallotte River, and Fl. Beacon “48A”, near Lockwoods Folly Inlet.

All those waters between the permanent closure line at Snows Cut and IWW Beacon “32” near Lockwoods Folly River, to include Cape Fear River.

All those waters in Bear Creek (Pamlico County) upstream of a line at the mouth between Sand Point and Sanders Point.

All those waters in Swanquarter Bay upstream of a line beginning at a point on the west shore at 34° 24.6204’ N -76° 21.0791’ W; running southeasterly to a point on the east shore at 34° 24.5704’ N -76° 20.9404’ W.

All those waters within 100 yards of the Outfall Canal near North Bluff Point.

All those waters in Hickory Creek upstream of a line at the mouth.

All those waters in Wysocking Bay upstream of a line beginning at a point on the west shore at Mackey Point; running southeasterly to a point on the east shore at 35° 25.1187’ N -76° 2.0775’ W near the mouth of Lone Tree Creek.

All those waters within 100 yards of the outfall canal near Brooks Creek.

All those waters in Long Shoal River upstream of a line beginning at a point on the west shore at 35° 37.3324’ N -75° 53.0802’ W; running easterly to a point on the east shore at 35° 37.2114’ N -75° 52.2099’ W.

All those waters 200 yards offshore between the north side of Ocracoke Inlet and the south side of Oregon Inlet, to include Ocracoke and Hatteras Islands.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: Myrtle Grove Sound, Masonboro Sound, a portion of Stump Sound, Chadwick Bay, Freeman Creek, Bear Creek (Onslow County), Newport River.

D. These reopenings are due to satisfactory bacteriological sampling results.
