PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Stephen W. Murphey, Director, Division of Marine Fisheries, upon the recommendation of Betsey Tilson, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Wednesday, October 10, 2018.

All those waters in New Hanover, Pender, Onslow, and Carteret Counties will return to the status in existence immediately prior to the September 13, 2018 temporary closures except the following which will remain closed.

NEW HANOVER / ONSLOW / CARTERET COUNTIES

All those waters bordered on the northeast by the Figure Eight Island Bridge; and bordered on the southwest by the South Carolina State Line, to include all of Brunswick County, Cape Fear River, Myrtle Grove Sound, Masonboro Sound, and a portion of Middle Sound.

All those waters in New River upstream of the Highway 172 Bridge.

All those waters, from the Intracoastal Waterway to the mainland, between IWW Marker “45A” (34° 40.3904’N - 77° 05.9365’ W) near Cedar Point and IWW Beacon “55” (34° 38.5749’N - 77° 10.8033’ W) near Goose Creek, to include Queens Creek and White Oak River.

All those waters in Bogue Sound bordered on the east by the permanent closure line near Fort Macon and bordered on the west by a line beginning at a point 34°40.4490’N - 77°05.9501’ W on the mainland, running southerly near Marker “45A” and following the eastern shore of Coast Guard Channel near Beacon “5” to a point 34°39.1597’N - 77°05.7070’ W along the Coast Guard Channel on Emerald Isle.

Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.

The following also remains closed:

BRUNSWICK / PAMLICO / BEAUFORT / HYDE / DARE COUNTIES


All those waters bordered on the northeast by the Figure Eight Island Bridge; and bordered on the southwest by the South Carolina State Line, to include all of Brunswick County, Cape Fear River, Myrtle Grove Sound, Masonboro Sound, and a portion of Middle Sound.

All those waters bordered on the east by a line beginning at Willow Point near Spencer Bay, running southerly to Pamlico Point; thence running southerly to Little Porpoise Point; thence running southerly to Big Porpoise Point; thence running southerly to Sow Island Point; thence running southwesterly to Bay Point; thence running southerly to Maw Point; thence running southeasterly to Fl. Beacon “NR”; thence running southwesterly to a point 34° 58.3128' N - 76° 43.7327' W in the Neuse River, thence running northwesterly to a point 34° 59.5689' N - 76° 45.3295' W on the shoreline near Dawson Creek, to include a portion of Neuse River, Bay River, Jones Bay, Middle Bay, Big Porpoise Bay, Mouse Harbor, Oyster Creek, Goose Creek, Pamlico River, and Pungo River.

All those waters in Croatan Sound and Stumpy Point Bay north of a line beginning at a point 35° 49.1512' N -75° 37.5280' W on the southern tip of Roanoke Island, running southwesterly to a point 35° 37.5368' N -75° 44.1327' W near Sandy Point.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. This proclamation returns the following areas to normal closure boundaries: Topsail Sound, Old Topsail Creek, Virginia Creek, Stump Sound, Alligator Bay, Chadwick Bay, a portion of New River, Bear Creek, Browns Inlet, Bear Inlet, Bogue Inlet, North River, Wards Creek, and Back Sound.

E. These reopenings are due to satisfactory bacteriological sampling results.
