PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Braxton Davis, Director, Division of Marine Fisheries, upon the recommendation of Betsey Tilson, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Wednesday, November 8, 2017.

All those waters in Brunswick, Onslow, and Carteret Counties will return to the status in existence immediately prior to the October 24 and October 30, 2017 temporary closures except the following which will remain closed:

ONSLOW / CARTERET COUNTIES

All those waters from the Intracoastal Waterway to the mainland between IWW Marker “49”, near Swansboro, and IWW Marker “58”, near Bear Creek, to include Queens Creek and Bear Creek.

All those waters near the Swansboro waterfront bordered on the southeast by a line starting at a point 34° 40.9479’ N -77° 07.1405' W, near IWW Beacon “47”, running southwesterly to a point 34° 40.3029' N -77° 08.0079' W, near IWW Beacon “49”.

Newport River – All those waters in Newport River upstream of a line beginning at a point on the south shore at 34° 45.7044' N -76° 43.4977' W near Penn Point; running northerly to a point on the west shore of Harlowe Creek at 34° 46.6935' N -76° 43.4719' W.

The following also remains closed:

NEW HANOVER COUNTY

All those waters, Intracoastal Waterway to the mainland, between IWW Marker “149”, near Everett Creek, and IWW Marker “155”, near Carolina Beach Inlet.

All those waters, Intracoastal Waterway to the mainland, between the Figure Eight Island Bridge and IWW Marker “134”, north of Whiskey Creek.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. This proclamation returns the following areas to normal closure boundaries: Ocean Isle, Shallotte River, Lockwoods Folly River, White Oak River, and the Bogue Inlet area.

E. These reopenings are due to satisfactory bacteriological sampling results.
