RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following shellfish area changes and closures will take effect at immediately:
No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas:
The following changes are additional closures to shellfish harvesting and the new closure descriptions are as follows:
BRUNSWICK / ONSLOW / DARE COUNTIES
SHALLOTTE RIVER AREA (A-2) – Map 49
b) Intracoastal Waterway Area - All those waters bordered on the west by a straight line beginning at a point 33º 54.9700' N -78º 19.3849' W on the north shore of the IWW; running southerly near IWW Beacon “63” to a point 33º 54.8565' N -78º 19.3962' W on the south shore of the IWW; and bordered on the east by a straight line beginning at a point 33º 55.0034' N -78º 16.2219' W on the north shore of the IWW; running southerly near IWW Beacon “51A” to a point 33º 54.9402' N -78º 16.2224' W on the south shore of the IWW; to include the canals near Greensboro Street on Holden Beach, the canals near Starfish Drive on Holden Beach, and Sea Air Boat Basin.
j) Old Ferry Seafood - All those waters within 100 feet from the dockage at Old Ferry Seafood beginning at a point 33º 55.1164' N -78º 15.7486' W on the shore west of the dockage area; running southerly to a point 33º 55.0876' N -78º 15.7489' W in the IWW; running easterly to a point 33º 55.0869' N -78º 15.6279' W in the IWW; running northerly to a point 33º 55.1155' N -78º 15.6276' W on the shore east of the dockage area.
QUEENS CREEK AREA (D-2) – Map 36
e) Shell Rock Landing Boat Launch Area - All those waters within the boat launch basin area beginning at a point 34º 39.1461' N -77º 10.0427' W on the shore west of the basin; running southeasterly to a point 34º 39.1198' N -77º 10.0052' W on the marsh; running northeasterly to a point 34º 39.1541' N -77º 09.9675' W on the shore near the entrance to the basin.
CROATAN SOUND AREA (H-2) – Map 5
c) Spencer and Callaghan Creeks - All those waters upstream of a straight line beginning at a point 35º 51.6745' N -75º 44.9086' W on the shore north of Spencer Creek; running southerly to a point 35º 51.0249' N -75º 45.0629' W on the shore south of Callaghan Creek; to include all of Spencer and Callaghan Creeks.
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This amends N.C. Marine Fisheries Proclamation PA-PC-2013, (49) (b), (49) (j), and Map 49, and closes approximately 150 acres, and; N.C. Marine Fisheries Proclamation PA-PC-2013, (36) (e) and Map 36 and closes approximately 1 acre, and; N.C. Marine Fisheries Proclamation PA-PC-2013, (5) (c), (5) (d), (5) (e), Map 5, and deletes (5) (f) and closes approximately 25 acres.
D. These closures are due to recent Sanitary Surveys in the Shallotte River area of Brunswick County, the Queens Creek area of Onslow County, and the Croatan Sound area of Dare County.
