PROCLAMATION
RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Laura Gerald, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Friday, February 15, 2013.
All those waters in Onslow and Carteret Counties will return to the status in existence immediately prior to the February 8, 2013 temporary closures except the following which will remain closed:
ONSLOW / CARTERET COUNTIES
All those waters in Stump Sound between IWW Channel Marker #29 near Turkey Creek and IWW Channel Marker #45, near Kings Creek.
All those waters from the IWW to the mainland between the Morehead City permanent closure line near 16th Street in Carteret County, to IWW Channel Marker #58, near Bear Creek, to include Bear Creek, Queens Creek, White Oak River, and all other creeks and tributaries within said boundaries.
Newport River – All those waters in Newport River upstream of a line beginning near Penn Point on the south shore at a point 34° 45.6960' N - 76° 43.5180' W running northeasterly to a point 34° 46.5733' N - 76° 42.6350' W on the north shore near Hardesty Farms subdivision.
Ward Creek - Ward Creek - All those waters in Ward Creek upstream of a line beginning at a point on the north shore at 34° 46.2667' N - 76° 35.4933' W, running southerly to a point on the south shore at 34° 45.4517' N - 76° 35.1767' W. (Ward Creek DMF Shrimp Line).
Whitehurst Creek – All those waters in Whitehurst Creek upstream of a straight line across the mouth.
Sleepy Creek – All those waters in Sleepy Creek upstream of a straight line across the mouth.
Oyster Creek - All those waters in Oyster Creek upstream of a straight line across the mouth.
South River – All those waters in South River upstream of a straight line across the mouth.
The following also remains closed:
BRUNSWICK COUNTY
All those waters within 100 yards from the dredge spoils effluent pipe near Bald Head Island located approximately 200 yards north of the mouth of Bald Head Creek.
GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This proclamation returns the following area to normal closure boundaries: a portion of Newport River, North River, Jarrett Bay, Brett Bay, Nelson Bay, and Thorofare Bay.
D. These reopenings are due to satisfactory bacteriological sampling results.
