PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Braxton Davis, Director, Division of Marine Fisheries, upon the recommendation of Betsey Tilson, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Saturday, November 4, 2017.

All those waters in Brunswick, New Hanover, and Carteret Counties will return to the status in existence immediately prior to the October 24, 2017 temporary closures except the following which will remain closed:

BRUNSWICK / NEW HANOVER / CARTERET COUNTIES

All those waters between IWW Marker "84" and IWW Marker “89”, near Ocean Isle.

Shallotte River - All those waters in Shallotte River upstream of a straight line beginning at a point 33° 55.3874’ N -78° 22.2861’ W on the western shore of the Shallotte River approximately 650 yards south of The Swash; running easterly to a point 33° 55.3385’ N -78° 21.7279’ W on the eastern shore of the Shallotte River approximately 650 yards south of Shallotte Creek (see map).

All those waters between Southport and IWW Channel Marker #51A, near the Holden Beach Bridge, to include all of Lockwoods Folly River and the Lockwoods Folly River Inlet area.

All those waters, Intracoastal Waterway to the mainland, between IWW Marker “149”, near Everett Creek, and IWW Marker “155”, near Carolina Beach Inlet.

All those waters, Intracoastal Waterway to the mainland, between the Figure Eight Island Bridge and IWW Marker “134”, north of Whiskey Creek.

All those waters between the Emerald Isle High-rise Bridge and a line beginning at a point on the mainland near Goose Creek (Onslow County), running southerly through IWW Flashing Beacon #55 and following the eastern shore of Sanders Creek to the western tip of Bear Island, to include White Oak River and Queens Creek.

Newport River – All those waters in Newport River upstream of a line beginning at a point on the south shore at 34° 45.7044' N -76° 43.4977' W near Penn Point; running northerly to a point on the west shore of Harlowe Creek at 34° 46.6935' N -76° 43.4719' W.

The following also remains closed:

PENDER / ONSLOW COUNTIES

All those waters bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of the New River Inlet), and bordered on the southwest by the Surf City Bridge.

All those waters, IWW to the mainland, between IWW Fl. Beacon "55” near Goose Creek (Onslow County) and IWW Fl. Beacon "59", near Shacklefoot Channel, to include Bear Creek.

All those waters between the Emerald Isle High-rise Bridge and a line beginning at a point on the mainland near Goose Creek (Onslow County), running southerly through IWW Flashing Beacon #55 and following the eastern shore of Sanders Creek to the western tip of Bear Island, to include White Oak River and Queens Creek.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. This proclamation returns the following areas to normal closure boundaries: Tubbs Inlet, a portion of Shallotte River, a portion of Myrtle Grove Sound, a portion of Masonboro Sound, a portion of Bogue Sound, a portion of Newport River, and North River.

E. These reopenings are due to satisfactory bacteriological sampling results.
