PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Megan Davies, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Friday, October 16, 2015.

All those waters in Brunswick, Pamlico, Beaufort and Hyde Counties will return to the status in existence immediately prior to the September 25, October 2, October 3, and October 5, 2015, temporary closures except the following which will remain closed:

BRUNSWICK / PAMLICO / BEAUFORT / HYDE COUNTIES

All those waters between Beacon "89", near Ocean Isle, and the South Carolina State Line, to include the Tubbs Inlet area.

All those waters in the Intracoastal Waterway at Holden Beach between Beacon “71”, near Shallotte River, and Fl. Beacon “48A”, near Lockwoods Folly Inlet.

All those waters between IWW Marker “139”, near Whiskey Creek, and IWW Beacon “32” near Lockwoods Folly River, to include Cape Fear River and Myrtle Grove Sound.

All those waters north and west of a line beginning at Maw Point near the mouth of Bay River; thence in a straight line to Piney Point near Broad Creek; thence in a straight line across the mouth of Broad Creek to a point near Gum Thicket Creek; thence in a straight line to Cockle Point, near Orchard Creek; to include Broad Creek and Orchard Creek.

All those waters in Bear Creek upstream of a line at the mouth between Sand Point and Sanders Point.

All those waters in Pungo River upstream of a straight line between Old Field Point and Lupton Point, to include Fortesque Creek, Slade Creek and Jordan Creek.

All those waters north and west of a line beginning at Long Shoal Point thence in a straight line to Long Point; thence in a straight line to the southernmost tip of Hog Island; thence in a straight line to Bluff Point; thence in a straight line to the southernmost point on Great Island Marsh; thence in a straight line to Shell Point on the west shore of Swanquarter Bay; thence in a straight line to Willow Point near Abel Bay; to include all of Spencer Bay, Rose Bay, Swanquarter Bay, Juniper Bay, West Bluff Bay, East Bluff Bay, Wysocking Bay, Long Shoal River and all other tributaries within said boundaries.

All those waters┬┐200 yards offshore between the north side of Ocracoke Inlet and the south side of Oregon Inlet, to include Ocracoke and Hatteras Islands.

The following also remains closed:

NEW HANOVER / PENDER / ONSLOW / CARTERET COUNTIES

All those waters between IWW Marker “139”, near Whiskey Creek, and IWW Beacon “32” near Lockwoods Folly River, to include Cape Fear River and Myrtle Grove Sound.

All those waters bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by the Wrightsville Beach permanent closure line.

All those waters between the Emerald Isle Bridge and IWW #65A, located just west of Salliers Bay, to include, Salliers Bay, Freeman Creek, Bear Creek, Queens Creek, White Oak River, and all other creeks and tributaries within said boundaries.

Bogue Sound – All those waters in Bogue Sound 200 yards offshore of Pine Knoll Shores between the permanent closure line at 34º 42.2026' N -76º 48.0601' W and the permanent closure line at Hoop Pole Creek at 34º 42.1465' N -76º 46.1560' W.

Newport River - All those waters in Newport River upstream of a straight line beginning at a point on the south shore at 34° 45.6646' N – 76° 44.0603’ W, at Lawton Point; thence to a point on the north shore at 34º 46.5724' N -76º 44.3786' W just upstream of Hammock Rock and east of a line beginning on the southwest tip of Core Creek; running easterly to IWW Beacon “24”; running southeasterly following the Intracoastal Waterway to IWW Beacon “28”; running southwesterly following the Intracoastal Waterway to IWW Beacon “34”; running southwesterly following the Intracoastal Waterway to IWW Beacon “38”; running southerly following the Intracoastal Waterway to the Morehead High Rise Bridge; to include Core Creek, the eastern part of Newport River, and the Causeway Bays.

Back Sound – All those waters between the permanent closure line at Fort Macon and a line running from Channel Marker #56B southwesterly to the Rock Jetty on Shackleford Banks.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: Shallotte River, Lockwoods Folly River, a portion of Bay River, Jones Bay, Goose Creek, Pamlico River, Abel Bay, Oyster Creek, Middle Prong Creek, Mouse Harbor, Big Porpoise Bay and Middle Bay.

D. These reopenings are due to satisfactory bacteriological sampling results.
