PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Stephen W. Murphey, Director, Division of Marine Fisheries, upon the recommendation of Betsey Tilson, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Thursday, October 4, 2018.

All those waters in Carteret County will return to the status in existence immediately prior to the September 13, 2018 temporary closures except the following which will remain closed.

CARTERET COUNTY


All those waters bordered on the northeast by a line beginning at a point 34° 43.2724’ N - 76° 34.5238’ W on the mainland at the Harkers Island Bridge at The Straits, running southerly following Harkers Island Road and the bridges to a point 34° 42.8644’ N - 76° 34.7019’ W on Harkers Island; thence running southerly following the western shore of Harkers Island to a point at the southwestern tip of Harkers Island at 34° 42.0981' N - 76° 35.0718' W; thence running southerly through Bottle Run Point to a point on Shackleford Banks at 34° 40.1094' N - 76° 35.1799' W; and bordered on the southwest by the South Carolina State Line, to include all of Brunswick, New Hanover, Pender, and Onslow Counties, White Oak River, Bogue Sound, Newport River, North River, and a portion of Back Sound.

Whitehurst Creek – All those waters in Whitehurst Creek upstream of a straight line across the mouth, beginning at a point 34° 43.5146' N - 76° 33.3428' W on the west shore; running easterly to a point 34° 43.5511' N - 76° 33.1664' W on the east shore.

Nelson Bay - All those waters in Nelson Bay upstream of a line from Drum Point to the northern tip of Fulchers Creek.

All those waters bordered on the east by a line beginning at a point 35° 37.5368' N -75° 44.1327' W near Sandy Point and Stumpy Point Bay, thence running southwesterly to a point 35° 05.9383' N -76° 02.8513' W near the northern tip of Beacon Island, thence running southwesterly to a point 35° 00.3020' N -76° 16.5345' W on the north shore of Cedar Island, to include West Bay, Long Bay, Turnagain Bay, Neuse River, Bay River, Jones Bay, Pamlico River, Pungo River, Rose Bay, Swanquarter Bay, Juniper Bay, Wysocking Bay, Long Shoal River, and portions of Pamlico Sound.

The following also remains closed:

BRUNSWICK / NEW HANOVER / PENDER / ONSLOW / CRAVEN / PAMLICO / BEAUFORT / HYDE / DARE COUNTIES

All those waters bordered on the northeast by a line beginning at a point 34° 43.2724’ N - 76° 34.5238’ W on the mainland at the Harkers Island Bridge at The Straits, running southerly following Harkers Island Road and the bridges to a point 34° 42.8644’ N - 76° 34.7019’ W on Harkers Island; thence running southerly following the western shore of Harkers Island to a point at the southwestern tip of Harkers Island at 34° 42.0981' N - 76° 35.0718' W; thence running southerly through Bottle Run Point to a point on Shackleford Banks at 34° 40.1094' N - 76° 35.1799' W; and bordered on the southwest by the South Carolina State Line, to include all of Brunswick, New Hanover, Pender, and Onslow Counties, White Oak River, Bogue Sound, Newport River, North River, and a portion of Back Sound.

All those waters bordered on the east by a line beginning at a point 35° 37.5368' N -75° 44.1327' W near Sandy Point and Stumpy Point Bay, thence running southwesterly to a point 35° 05.9383' N -76° 02.8513' W near the northern tip of Beacon Island, thence running southwesterly to a point 35° 00.3020' N -76° 16.5345' W on the north shore of Cedar Island, to include West Bay, Long Bay, Turnagain Bay, Neuse River, Bay River, Jones Bay, Pamlico River, Pungo River, Rose Bay, Swanquarter Bay, Juniper Bay, Wysocking Bay, Long Shoal River, and portions of Pamlico Sound.

All those waters in Croatan Sound and Stumpy Point Bay north of a line beginning at a point 35° 49.1512' N -75° 37.5280' W on the southern tip of Roanoke Island, running southwesterly to a point 35° 37.5368' N -75° 44.1327' W near Sandy Point.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C.  In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. This proclamation returns the following areas to normal closure boundaries: The Straits, Sleepy Creek, Jarrett Bay, Oyster Creek, Brett Bay, Barry Bay, Thorofare Bay, Lewis Creek, Cedar Island Bay, and Core Sound.

E. These reopenings are due to satisfactory bacteriological sampling results.
