PROCLAMATION
RE: SHELLFISH POLLUTED AREA
Braxton Davis, Director, Division of Marine Fisheries, upon the recommendation of Randall Williams, M.D., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting area will take effect at sunrise, Wednesday, September 14, 2016.
All those waters in Brunswick County will return to the status in existence immediately prior to the September 3, 2016, temporary closures except the following which remains closed:
BRUNSWICK COUNTY
All those waters between Southport and Intracoastal Waterway Beacon “89”, near Ocean Isle, to include Shallotte River and Lockwoods Folly River.
The following also remains closed:
NEW HANOVER / PENDER / ONSLOW / CARTERET / CRAVEN / PAMLICO / HYDE / DARE COUNTIES
All those waters in Myrtle Grove Sound bordered on the north by a straight line beginning at a point 34° 07.796’N – 77° 52.072’W near Peden Point; running easterly through Intracoastal Waterway Beacon “141” and US Army Corps of Engineers Spoils Island #261 to a point 34° 07.459’N – 77° 51.071’W on Masonboro Island; and bordered on the south by a straight line beginning at a point 34° 04.846’N -77° 53.102’W on the mainland; running easterly through Intracoastal Waterway Beacon “155” to a point 34° 04.809’N – 77° 52.907’ W on the southwestern tip of Masonboro Island at Carolina Beach Inlet.
All those waters, Intracoastal Waterway to the mainland, between IWW Beacon “98A”, near Forest Sound Marina, and the Wrightsville Beach Bridge.
All those waters bordered on the northeast by Fl. Beacon “65A”, near Salliers Bay; and bordered on the southwest by a line beginning at a point on the mainland near Forest Sound Marina, running southerly through IWW Beacon “98A”, following the eastern shore of Black Mud Channel to a point on the southern tip of Topsail Beach; to include a portion of Topsail Sound, Stump Sound, and New River.
All those waters, Intracoastal Waterway to the mainland between IWW Beacon “36”, near Goose Creek in Carteret County, and Fl. Beacon “65A”, near Salliers Bay, to include Goose Creek, Hunting Island Bay, Deer Creek, White Oak River, Queens Creek, Bear Creek, Freeman Creek, and Salliers Bay.
Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek
North River - All those waters in North River upstream of a straight line beginning at a point at the permanent closure line near Channel Marker #56B to the mainland side of the Harkers Island Bridge at the Straits.
All those waters in Long Bay and West Thorofare Bay south of a line beginning on the west shore at Jacks Bay Point, running easterly to Tump Point on the east shore.
All those waters in the Neuse River south and west of a line running from Deep Point to Point of Marsh, to include the Neuse River, Adams Creek, South River, Turnagain Bay, and Broad Creek.
All those waters bordered on the north by a straight line beginning at a point on Bodie Island at Mann Point, thence across Roanoke Sound and Croatan Sound to a point near Redstone Point; and bordered on the south by a line beginning at the northern tip of Portsmouth Island, running northwesterly to Roos Point, near Spencer Bay, to include Ocracoke, a portion of Pamlico Sound, Spencer Bay, Rose Bay, Deep Bay, Swanquarter Bay, Juniper Bay, West Bluff Bay, East Bluff Bay, Wysocking Bay, Long Shoal River, Pains Bay, Sandy Bay, Parched Corn Bay, Stumpy Point Bay, Roanoke Sound, Croatan Sound, and all other tributaries within said boundaries.
GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.
D. This proclamation returns the following area to normal closure boundaries: Tubbs Inlet.
E. This reopening is due to satisfactory bacteriological sampling results.
