PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Megan Davies, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Wednesday, October 14, 2015.

All those waters in Onslow and Carteret Counties will return to the status in existence immediately prior to the September 25, September 26, September 28, October 2, and October 3, 2015, temporary closures except the following which will remain closed:

ONSLOW / CARTERET COUNTIES

All those waters
bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by South Carolina state line.

All those waters between the Emerald Isle Bridge and IWW #65A, located just west of Salliers Bay, to include, Salliers Bay, Freeman Creek, Bear Creek, Queens Creek, White Oak River, and all other creeks and tributaries within said boundaries.

Bogue Sound – All those waters in Bogue Sound 200 yards offshore of Pine Knoll Shores between the permanent closure line at 34º 42.2026' N -76º 48.0601' W and the permanent closure line at Hoop Pole Creek at 34º 42.1465' N -76º 46.1560' W.

Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.

North River - All those waters in North River upstream of a line beginning at a point on the west shore at 34° 46.0383' N - 76° 37.0633' W, running easterly to a point on the east shore at 34° 46.2667' N - 76° 35.4933' W. (North River DMF Shrimp Line).

Whitehurst Creek - All those waters in Whitehurst Creek upstream of a straight line across the mouth.

Sleepy Creek – All those waters in Sleepy Creek upstream of a straight line across the mouth.

Back Sound – All those waters between the permanent closure line at Fort Macon and a line running from Channel Marker #56B southwesterly to the Rock Jetty on Shackleford Banks.

Jarrett Bay - All those waters upstream of a line beginning at a point on the east shore of Spit Bay; thence in a straight line to the southern end of Davis Island; thence in a straight line thru Flashing Beacon #36; thence in a straight line to the southeast end of Bells Island; thence in a straight line to a point on the Marshallberg shoreline.

All those waters north and west of a line beginning at Long Shoal Point thence in a straight line to Long Point; thence in a straight line to the southernmost tip of Hog Island; thence in a straight line to Bluff Point; thence in a straight line to the southernmost point on Great Island Marsh; thence in a straight line to Sow Island Point on the north shore of Jones Bay; thence in a straight line to the northeastern end of Maw Point near the mouth of Bay River; thence in a straight line to the north end of Point of Marsh; thence in a straight line to a point on the northwestern shore of North Bay, and bordered to the south by NC Hwy 12 at Cedar Island and NC Hwy 70 at Sea Level; to include all of Long Shoal River, Wysocking Bay, East Bluff Bay, West Bluff Bay, Juniper Bay, Swanquarter Bay, Rose Bay, Spencer Bay, Pungo River, Pamlico River, Mouse Harbor, Jones Bay, Bay River, Neuse River, West Bay, North Bay and all other tributaries within said boundaries.

The following also remains closed:

BRUNSWICK / PENDER / NEW HANOVER / PAMILICO / DARE / HYDE COUNTIES

All waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by South Carolina state line.

All those waters north and west of a line beginning at Long Shoal Point thence in a straight line to Long Point; thence in a straight line to the southernmost tip of Hog Island; thence in a straight line to Bluff Point; thence in a straight line to the southernmost point on Great Island Marsh; thence in a straight line to Sow Island Point on the north shore of Jones Bay; thence in a straight line to the northeastern end of Maw Point near the mouth of Bay River; thence in a straight line to the north end of Point of Marsh; thence in a straight line to a point on the northwestern shore of North Bay, and bordered to the south by NC Hwy 12 at Cedar Island and NC Hwy 70 at Sea Level; to include all of Long Shoal River, Wysocking Bay, East Bluff Bay, West Bluff Bay, Juniper Bay, Swanquarter Bay, Rose Bay, Spencer Bay, Pungo River, Pamlico River, Mouse Harbor, Jones Bay, Bay River, Neuse River, West Bay, North Bay and all other tributaries within said boundaries.

All those waters¿200 yards offshore between the north side of Ocracoke Inlet and the south side of Oregon Inlet, to include Ocracoke and Hatteras Islands.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.PA-107-2015

C. This proclamation returns the following areas to normal closure boundaries: Cedar Island Bay, Lewis Creek, Rumley Bay, Thorofare Bay, Barry Bay, Nelson Bay, Brett Bay, Oyster Creek, a portion of Core Sound, the Straits, Eastmouth Bay, Westmouth Bay, a portion of Back Sound, a portion of North River, Tar Landing Bay, a portion of Bogue Sound, and New River.

D. These reopenings are due to satisfactory bacteriological sampling results.
