PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Braxton Davis, Director, Division of Marine Fisheries, upon the recommendation of Betsey Tilson, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Saturday, October 28, 2017.

All those waters Carteret County will return to the status in existence immediately prior to the October 24, 2017 temporary closures except the following which will remain closed:

CARTERET COUNTY

All those waters between the Emerald Isle High-rise Bridge and a line beginning at a point on the mainland near Goose Creek (Onslow County), running southerly through IWW Flashing Beacon #55 and following the eastern shore of Sanders Creek to the western tip of Bear Island, to include White Oak River and Queens Creek.

Bogue Sound - All those waters, Intracoastal Waterway to the mainland
between the Atlantic Beach High-rise Bridge and the Emerald Isle High-rise Bridge.

Newport River – All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.

North River – All those waters in North River upstream of a line beginning at a point on the west shore at 34° 46.0383' N - 76° 37.0633' W, running easterly to a point on the east shore at 34° 46.2667' N - 76° 35.4933' W. (North River DMF Shrimp Line).

Oyster Creek - All those waters in Oyster Creek upstream of a straight line across the mouth.

The following also remains closed:

BRUNSWICK / NEW HANOVER / ONSLOW COUNTIES

All those waters between IWW Marker "84" near Ocean Isle and the South Carolina State Line, to include the Tubbs Inlet area.

Shallotte River - All those waters in Shallotte River upstream of a straight line from Bowen Point to Long Point.

All those waters between Southport and IWW Channel Marker #51A, near the Holden Beach Bridge, to include all of Lockwoods Folly River and the Lockwoods Folly River Inlet area.

All those waters, Intracoastal Waterway to the mainland, between the Figure Eight Island Bridge and IWW Beacon “155”, near Carolina Beach Inlet.

All those waters between the Emerald Isle High-rise Bridge and a line beginning at a point on the mainland near Goose Creek (Onslow County), running southerly through IWW Flashing Beacon #55 and following the eastern shore of Sanders Creek to the western tip of Bear Island, to include White Oak River and Queens Creek.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C.  In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. This proclamation returns the following area to normal closure boundaries: a portion of Bogue Sound, Tar Landing Bay, a portion of North River, Ward Creek, The Straits, Whitehurst Creek, Sleepy Creek, and Jarrett Bay.

E. These reopenings are due to satisfactory bacteriological sampling results.
