PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Thursday, October 1, 2015.

All those waters in Onslow and Carteret Counties will return to the status in existence immediately prior to the September 28, 2015, temporary closures except the following which will remain closed:

ONSLOW / CARTERET COUNTIES

All those waters from the IWW to the mainland between IWW Beacon “4”, near Swan Point and IWW Beacon “99B”, near Howard Landing, to include Chadwick Bay, Alligator Bay, Becky’s Creek, Virginia Creek, Old Topsail Creek, and other creeks and tributaries within said boundaries.

Queens Creek - All those waters in Queens Creek upstream of a straight line across the mouth.

White Oak River - All those waters in White Oak River upstream of the Highway 24 Bridge at Swansboro.

All those waters, from the IWW to the mainland between IWW Beacon “29”, near Salty Shores, and the Emerald Isle High rise Bridge, to include Sanders Creek, Goose Creek, Hunting Island Bay, and Deer Creek.

All those waters bordered on the east and south by a line beginning at Long Point near Rumley Bay thence in a straight line to Lookout Point on the east shore of Thorofare Bay, thence in a straight line across Thorofare Bay to Hall Point near Atlantic, thence in a straight line to Fl. Beacon #20 in Core Sound, thence in a straight line to Fl. Beacon #27 in Core Sound, thence in a straight line to Fl. Beacon #37 in Core Sound, thence in a straight line to Shell Point on Harkers Island, then in a straight line across Back Sound to a point on Shackleford Banks near Baregrass Island at 34°39.01386’N - 76°32.50452’ W and bordered on the west by a line beginning at a point on the mainland near Salty Shores at 34°42.5761’N -76°57.3715’ W running southerly through IWW Beacon“29”, running southerly through Wood Island to a point on Bogue Banks at 34°40.7091’N - 76°57.0247’W. This includes, Thorofare Bay, Rumley Bay, Brett Bay, Nelson Bay, Oyster Creek, Jarrett Bay, Middens Creek, Tusk Creek, Jump Run Creek, Bells Creek, The Straits, Sleepy Creek, Whitehurst Creek, Eastmouth Bay, Westmouth Bay, a portion of Core Sound, a portion of Back Sound, all of North River, the North River Marshes, all of Newport River, Tar Landing Bay, a portion of Bogue Sound, and all creeks and tributaries within the described area.

The following also remains closed:

BRUNSWICK / PENDER COUNTIES

All those waters between IWW Marker "89" near Ocean Isle and the South Carolina State Line, to include the Tubbs Inlet area.

Lockwoods Folly River - All those waters north of a line beginning on the west shore at a point 33°55.7954’N - 78°13.3096’ W approximately midway between Genoes Point and Spring Creek; running southeasterly to a point 33°55.2284’N - 78°12.7791’ W near the northwest point of Horse Island, to include the open portion of the Atlantic Intracoastal Waterway north of Horse Island.

All those waters from the IWW to the mainland between IWW Beacon “4”, near Swan Point and IWW Beacon “99B”, near Howard Landing, to include Chadwick Bay, Alligator Bay, Becky’s Creek, Virginia Creek, Old Topsail Creek, and other creeks and tributaries within said boundaries.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: Bear Creek, IWW area between Emerald Isle Bridge and IWW Beacon “59”, and a portion of Bogue Sound.

D. These reopenings are due to satisfactory bacteriological sampling results.
