PROCLAMATION
RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Megan Davies, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise Thursday, January 28, 2016.
All those waters in Pender, Onslow and Carteret Counties will return to the status in existence immediately prior to the January 16, 2016 and January 23, 2016 temporary closures except the following which will remain closed:
ONSLOW / CARTERET COUNTIES
All those waters bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of the New River Inlet), and bordered on the southwest by IWW Beacon “57” near the Old Settlers Canals.
All those waters from the Intracoastal Waterway to the mainland between the Emerald Isle High Rise Bridge and IWW Beacon “59”, located just west of Bear Creek, to include White Oak River, Queens Creek, and Bear Creek.
Bogue Sound - All those waters, from the IWW to the mainland in Bogue Sound between IWW Beacon “27” and Fl Beacon “25” near Broad Creek, to include Broad Creek.
Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.
North River - All those waters upstream of a straight line beginning at a point on the northwest shore of Goose Bay thence in a straight line across the river near the old Fl. "Danger" Beacon; thence to a point at 34°44.4581’N - 76°37.3826’ W; on the shore south of Cow Pen Creek to include all of Ward Creek.
All those waters in Jarrett Bay upstream of a line beginning at a point on the east shore of Spit Bay; thence in a straight line to the northern tip of Davis Island; then in a straight line to the "Chimney" near Jump Run Creek.
Nelson Bay - All those waters in Nelson Bay upstream of a line from Drum Point to the northern tip of Fulchers Creek.
The following also remains closed:
BRUNSWICK COUNTY
All those waters between IWW Beacon “84” and IWW Beacon “89” near Ocean Isle.
Shallotte River - All those waters in Shallotte River upstream of a straight line from Bowen Point to Long Point.
All those waters between Southport and IWW Channel Marker #51A, near the Holden Beach Bridge, to include all of Lockwoods Folly River and the Lockwoods Folly River Inlet area.
GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This proclamation returns the following areas to normal closure boundaries: A portion of Stump Sound near Waters Bay, Salliers Bay, Freeman Creek, a portion of Bogue Sound near Sanders Creek, a portion of North River, and Sleepy Creek.
D. These reopenings are due to satisfactory bacteriological sampling results.
