RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Sunday, February 16, 2014.
All those waters in Onslow and Carteret Counties will return to the status in existence immediately prior to the February 13, 2014, temporary closures except the following which will remain closed:
ONSLOW / CARTERET COUNTIES
Bear Creek - All those waters in Bear Creek upstream of a straight line across the mouth.
Queens Creek - All those waters in Queens Creek upstream of a straight line across the mouth.
White Oak River - All those waters in White Oak River upstream of the Highway 24 Bridge at Swansboro.
Newport River – All those waters in Newport River upstream of a line across the river from Crab Point to the southern end of the west shore of Core Creek.
Ward Creek - All those waters in Ward Creek upstream of a line beginning at a point on the north shore at 34° 46.2667' N - 76° 35.4933' W, running southerly to a point on the south shore at 34° 45.4517' N - 76° 35.1767' W. (Ward Creek DMF Shrimp Line).
The following also remains closed:
Hoop Pole Creek - All those waters in the Hoop Pole Creek area upstream of a line beginning on a point of marsh at 34°42.4519’ N -76°45.1967’ W; running southeasterly across the bay to a point of marsh at 34°42.4429’ N -76°45.1829’ W; running southeasterly following the shoreline to a point at 34°42.4069’ N -76°45.1285’ W; running southeasterly across the creek to a point 34°42.3984’ N -76°45.1098’ W on the eastern shore.
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This proclamation returns the following areas to normal closure boundaries: Sallier’s Bay, Freeman Creek, a portion of Newport River, and a portion of North River.
D. These reopenings are due to satisfactory bacteriological sampling results.
