PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Megan Davies, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise Wednesday, January 27, 2016.

All those waters in Brunswick, Onslow and Carteret Counties will return to the status in existence immediately prior to the December 31, 2015, January 16, 2016, and January 23, 2016 temporary closures except the following which will remain closed:

BRUNSWICK / ONSLOW / CARTERET COUNTIES

All those waters between IWW Beacon “84” and IWW Beacon “89” near Ocean Isle.

Shallotte River - All those waters in Shallotte River upstream of a straight line from Bowen Point to Long Point.

All those waters between Southport and IWW Channel Marker #51A, near the Holden Beach Bridge, to include all of Lockwoods Folly River and the Lockwoods Folly River Inlet area.

All those waters bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of the New River Inlet), and bordered on the southwest by the Surf City Bridge.

Salliers Bay - All those waters in Salliers Bay upstream of a straight line across the mouth.

Freeman Creek - All those waters in Freeman Creek upstream of a straight line across the mouth.

All those waters from the Intracoastal Waterway to the mainland between the Emerald Isle High Rise Bridge and IWW Beacon “59”, located just west of Bear Creek, to include White Oak River, Queens Creek, and Bear Creek.

Bogue Sound - All those waters, from the IWW to the mainland in Bogue Sound between IWW Marker “32” near Sanders Creek and and Fl Beacon “25” near Broad Creek, to include Sanders Creek and Broad Creek.

Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.

North River - All those waters in North River upstream of a straight line beginning at a point at the permanent closure line near Channel Marker #56B to the mainland side of the Harker’s Island Bridge at The Straits.
Sleepy Creek - All those waters in Sleepy Creek upstream of a straight line across the mouth.

All those waters in Jarrett Bay upstream of a line beginning at a point on the east shore of Spit Bay; thence in a straight line to the northern tip of Davis Island; then in a straight line to the "Chimney" near Jump Run Creek.

Nelson Bay - All those waters in Nelson Bay upstream of a line from Drum Point to the northern tip of Fulchers Creek.

The following also remains closed:

PENDER COUNTY

All those waters bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of the New River Inlet), and bordered on the southwest by the Surf City Bridge.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: Tubbs Inlet, a portion of the Intracoastal Waterway between IWW Channel Marker “65A” and IWW Fl. Beacon “59”, a portion of Bogue Sound, Whitehurst Creek, a portion of Jarrett Bay, Oyster Creek, and Brett Bay.

D. These reopenings are due to satisfactory bacteriological sampling results and sufficient time being elapsed to reduce pathogens that might have been present to acceptable levels.
