PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, February 6, 2014.

The new closure descriptions for the Goose Creek/Pamlico River, Wright and Oyster Creeks, and Pungo River areas are as follows:

No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas:

BEAUFORT / HYDE COUNTIES

GOOSE CREEK / PAMLICO RIVER AREA (G-1) - MAP 16

c) East Fork, Ross Creek and Bailey Creek – All those waters in East Fork upstream of a straight line beginning at a point 35º 25.8170' N -76º 39.0339' W on the north shore; running southeasterly to a point 35º 25.7342' N -76º 38.9372' W on the south shore; to include all of Ross Creek and Bailey Creek.

WRIGHT & OYSTER CREEKS AREA (G-2) - MAP 15

b) Wright Creek - All those waters in Wright Creek upstream of a straight line beginning at a point 35º 24.8634' N -76º 35.4188' W on the west shore; running southeasterly to a point 35º 24.8006' N -76º 35.3105' W on the east shore.

PUNGO RIVER AREA (G-8) - MAP 14

d) Slade Creek - All those waters in Slade Creek upstream of a straight line beginning at a point 35º 28.6460' N -76º 31.9206' W on the north shore; running easterly across the mouth of Neal Creek to a point 35º 28.6084' N -76º 31.6962' W; running southerly across Slade Creek to a point 35º 28.3877' N -76º 31.7073' W on the south shore.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This amends N.C. Marine Fisheries Proclamation PA-PC-2013, (16) (c), Map 16 and opens approximately 34 acres, and; N.C. Marine Fisheries Proclamation PA-PC-2013, (15) (b) and Map 15 and opens approximately 16 acres, and; N.C. Marine Fisheries Proclamation PA-PC-2013, (14) (d) and Map 14 and opens approximately 80 acres.

D. These openings are due to recent Sanitary Surveys in the Pamlico River and Pungo River areas of Beaufort and Hyde Counties.
