RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Thursday, January 23, 2014.
All those waters in Carteret County will return to the status in existence immediately prior to the November 27, December 3, December 15, 2013 and January 15, 2014, temporary closures except the following which will remain closed:
Hoop Pole Creek - All those waters in the Hoop Pole Creek area upstream of a line beginning on a point of marsh at 34°42.4519’ N -76°45.1967’ W; running southeasterly across the bay to a point of marsh at 34°42.4429’ N -76°45.1829’ W; running southeasterly following the shoreline to a point at 34°42.4069’ N -76°45.1285’ W; running southeasterly across the creek to a point 34°42.3984’ N -76°45.1098’ W on the eastern shore.
Cedar Island Bay - All those waters in Cedar Island Bay upstream of a straight line beginning at a point 35º 00.7577' N -76º 18.9039' W on the west shore; running easterly to a point 35º 00.7632' N -76º 18.8399' W on the marsh on the east shore.
The following also remains closed:
PENDER / DARE COUNTY
Mallard Bay - All those waters in Mallard Bay/Nixon’s Creek upstream of a straight line beginning at a point 34º 23.3819' N -77º 37.7503' W on the north shore; running southeasterly across the channel to a point 34º 23.3628' N -77º 37.7104' W on the south shore.
All those waters in Pamlico Sound 200 yards offshore of Hatteras Island between a point 200 yards north of the north drain at Rodanthe and a point 200 yards south of the south drain at Rodanthe.
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This proclamation returns the following areas to normal closure boundaries: Newport River, North River, Ward Creek, Whitehurst Creek, Sleepy Creek, and Jarrett Bay.
D. These reopenings are due to satisfactory bacteriological sampling results.
