RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following shellfish area temporary closures will take effect immediately:
No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas:
PENDER / CARTERET COUNTIES
Mallard Bay - All those waters in Mallard Bay/Nixon’s Creek upstream of a straight line beginning at a point 34º 23.3819' N -77º 37.7503' W on the north shore; running southeasterly across the channel to a point 34º 23.3628' N -77º 37.7104' W on the south shore (see map).
Cedar Island Bay - All those waters in Cedar Island Bay upstream of a straight line beginning at a point 35º 00.7577' N -76º 18.9039' W on the west shore; running easterly to a point 35º 00.7632' N -76º 18.8399' W on the marsh on the east shore (see map).
Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.
Jarrett Bay / North River and The Straits - All those waters bordered on the east by a line beginning at a point on the east shore of Spit Bay; thence in a straight line to the southern end of Davis Island; thence in a straight line thru Flashing Beacon #36; thence in a straight line to the southeast end of Bells Island; thence in a straight line to the eastern end of Browns Island; thence in a straight line to Shell Point on Harkers Island; thence following the shoreline to the southwestern tip of Harkers Island; thence in a straight line to Channel Marker #56A; thence proceeding thru Beacon #58 to Beacon #59 to a point on Carrot Island. This includes Middens Creek, Tusk Creek, Jump Run Creek, Bells Creek, The Straits, Eastmouth Bay, Westmouth Bay, all of North River, the North River Marshes, Sleepy Creek, Whitehurst Creek and all creeks and tributaries within the described area
Oyster Creek - All those waters in Oyster Creek upstream of the Hwy 70 Bridge.
The following also remains closed:
CARTERET / DARE COUNTIES
Hoop Pole Creek- All those waters in the Hoop Pole Creek area upstream of a line beginning on a point of marsh at 34°42.4519’ N -76°45.1967’ W; running southeasterly across the bay to a point of marsh at 34°42.4429’ N -76°45.1829’ W; running southeasterly following the shoreline to a point at 34°42.4069’ N -76°45.1285’ W; running southeasterly across the creek to a point 34°42.3984’ N -76°45.1098’ W on the eastern shore.
All those waters in Pamlico Sound 200 yards offshore of Hatteras Island between a point 200 yards north of the north drain at Rodanthe and a point 200 yards south of the south drain at Rodanthe.
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. These temporary closures are due to rainfall, resultant runoff, and recent Sanitary Surveys.
