PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Jeffrey P. Engel, M.D., State Health Director, Department of Health and Human Services, hereby announces that the following areas in Carteret County will open to shellfish harvesting on a temporary basis beginning at sunrise, Saturday, January 7, 2012.

CARTERET COUNTY

Bogue Sound Area – All those waters in the Bogue Sound closed area between Intracoastal Waterway Channel Markers #14 and #19 with the exception of all those waters in Gull Harbor and within 275 feet from the last dockage area, all those waters in Soundview canals and within 325 feet of the last dockage area, all those waters in Jumping Run Creek and within 275 feet of the last dockage area, and all other tributaries, creeks and canals from the mouth upstream within said boundaries (see map).

Newport River - All those waters in Newport River bounded on the west by a straight line beginning at a point on the north shore at 34º 45.8045' N -76º 45.2811' W; running southeasterly to a point on the south shore at 34º 44.8039' N -76º 44.9236' W and bounded on the east by a straight line beginning at a point on the north shore at 34º 46.0253' N -76º 45.0627' W; running southeasterly in a straight line to a point on the south shore at 34º 45.5461' N -76º 44.1308' W near Lawton Point (see map).

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103.

C. This proclamation temporarily opens a portion of Bogue Sound and a portion of Newport River.

D. These temporary openings are due to satisfactory bacteriological sampling results of both water and shellfish meats.
