PROCLAMATION
RE: HORSESHOE CRABS – COMMERCIAL FISHING OPERATIONS – CLOSURE
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 12:01 A.M., Saturday, September 1, 2012, the following restrictions will apply to the commercial horseshoe crab fishery:
I. SEASON
No person may possess, sell or offer for sale horseshoe crabs taken with commercial fishing equipment or for commercial purposes.
II. GENERAL INFORMATION
A. This proclamation is issued under the authority of N.C.G.S. 113- 170.4; 113-170.5;113-182; 113-221.1; 143B-289.52 and NC Marine Fisheries Rule 15A NCAC 03L .0207.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103.
C. Fisheries Rule 15A NCAC 03L .0207 (b) states that the Fisheries Director, by proclamation, may impose restrictions on the taking of horseshoe crabs to maintain compliance with the Atlantic States Marine Fisheries Commission Interstate Fishery Management Plan for Horseshoe Crab. This action has been taken because the commercial quota is close to being exceeded.
D. This proclamation supersedes Proclamation M-13-2012, dated March 22, 2012, which opened the season.
