PROCLAMATION

RE: DEALER PERMIT AND REPORTING REQUIREMENTS- FLOUNDER POUND NET DEALER PERMIT

Braxton C. Davis, Director, Division of Marine Fisheries, hereby announces effective at 12:01 A.M., Monday, August 1, 2016, the following restrictions implemented by proclamation M-14-2016 are rescinded:

I. FLOUNDER POUND NET DEALER PERMIT REQUIREMENTS

A. It is unlawful for a fish dealer to possess, buy, sell or offer for sale flounder taken from the pound net fishery without first obtaining a 2016 Flounder Pound Net Dealer Permit issued by the Division of Marine Fisheries. The 2016 Flounder Pound Net Dealer Permit expires June 30, 2017.

B. It is unlawful to fail to fax or send via electronic mail by noon on September 1, 2016, the August 2016 flounder pound net landings by each individual’s Standard Commercial Fishing License (SCFL) or Retired Standard Commercial Fishing License (RSCFL) number to the dealer contact designated on the permit. If the dealer is unable to fax or electronic mail the required information, the permittee shall call in the August 2016 flounder pound net landings to the division dealer contact designated on the permit and shall maintain a log furnished by the division. All information shall be submitted on the forms provided by the division.

C. It is unlawful to fail to fax or send via electronic mail by noon daily, beginning September 1, 2016, the previous day’s flounder pound net landings by each individual’s SCFL/RSCFL number to the division dealer contact designated on the permit. If the dealer is unable to fax or electronic mail the required information, the permittee shall call in the previous day’s landings to the division dealer contact designated on the permit and shall maintain a log furnished by the division. Landings for Fridays or Saturdays shall be submitted on the following Monday. All information shall be submitted on the forms provided by the division.

II. GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G.S. 113-182; 113-221.1;143B-289.52 and N.C. Marine Fisheries Rule 15A NCAC 03H .0103, 03O .0506.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. N.C. Marine Fisheries Commission Rule 15A NCAC 03I .0113 specifies that it is unlawful for any licensee under Chapter 113, Subchapter IV of the General Statutes to refuse to allow the Fisheries Director or his agents to obtain biological data, harvest information, or other statistical data necessary or useful to the conservation and management of marine and estuarine resources from fish in the licensee’s possession.

D. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

E. In accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03I .0114, a fish dealer must continue to meet all division record-keeping requirements. The Flounder Pound Net Quota Monitoring Reporting Form does not replace trip tickets.

F. In accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03O .0504, for violations of specific permit conditions (as stated on the permit) permits may be suspended or revoked.

G. In accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03O .0502, it is unlawful to operate under the permit except in areas, at times, and under conditions specified on the permit. It is unlawful to fail to provide reports within the timeframe required by the specific permit conditions. All other conditions listed under the above rule apply.

H. In accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03O .0501, Flounder Pound Net Dealer Permits are available at no cost from all Division of Marine Fisheries License Offices.

J. M-14-2016 is being rescinded effective 12:01 A.M., Monday, August 1, 2016. The Flounder Pound Net Dealer Permit will no longer be required and any permits already issued will not be valid.
