PROCLAMATION

RE: GILL NET RESTRICTIONS: ATLANTIC OCEAN WITHIN 100 YARDS OF THE SHORELINE


This proclamation supersedes proclamation M-20-2014, dated May 28, 2014. This proclamation makes it unlawful to use gill nets (except as described in Section II. B.) in the Atlantic Ocean within 100 yards of the shoreline.

Stephen W. Murphey, Director, Division of Marine Fisheries, hereby announces that effective at 12:01 A.M., Monday, April 22, 2019, the following restrictions will apply to gill nets in the Atlantic Ocean:

I. AREA DESCRIPTION
The Atlantic Ocean within 100 yards seaward:

A. The shoreline at any tide; and

B. The COLREGS demarcation lines from the North Carolina-Virginia border to the North Carolina-South Carolina border

II. GEAR RESTRICTION/EXCEPTION
The following conditions apply to the use of gill nets in the area described above:

A. It is unlawful to use gill nets (except as described in Section II. B.).

B. Run-around, strike or drop nets that are used to surround a school of fish and then immediately retrieved are exempt from this restriction.

III. GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G. S. 113-134; 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103 and 03J .0103.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This intent of this proclamation is to implement management recommendations of the Bottlenose Dolphin Take Reduction Team to minimize interactions with bottlenose dolphin in accordance with the Bottlenose Dolphin Take Reduction Plan.

D. In accordance with N.C. General Statute 113-221.1(c) All persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

F. This proclamation supersedes proclamation M-20-2014, dated May 28, 2014. This proclamation makes it unlawful to use gill nets (except as described in Section II. B.) in the Atlantic Ocean within 100 yards of the shoreline. This action expands the previous restriction on small mesh gill net use within 100 yards of the ocean surf zone to include large mesh gill nets. This action is being taken to implement management recommendations of the Bottlenose Dolphin Take Reduction Team to minimize interactions with bottlenose dolphin in accordance with the Bottlenose Dolphin Take Reduction Plan.
