RE: TEMPORARY SUSPENSION OF PARTIAL RULE - ATLANTIC OCEAN STRIPED BASS COMMERCIAL GEAR PERMIT – DATE OF AQUISITION
Dr. Louis B. Daniel III Director, Division of Marine Fisheries, hereby announces that effective at 12:00 Noon, Wednesday, February 26, 2014, the following provisions shall apply to North Carolina Marine Fisheries Commission Rules:
I. TEMPORARY SUSPENSION
North Carolina Marine Fisheries Commission Rule 15A NCAC 03O .0501(f) (1 )is modified by the suspension of the following wording: “prior to November 1 of”. The modified part of section (f) (1) now reads as follows:
(f) Atlantic Ocean Striped Bass Commercial Gear Permit:
(1) Application for an Atlantic Ocean Striped Bass Commercial Gear Permit must be made each year.
II. GENERAL INFORMATION
A. This proclamation is issued under the authority of N.C.G. S. 113-134; 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103, 3I .0102 and 03O .0501.
B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. The intent of this proclamation is to remove the November 1 deadline for obtaining an Atlantic Ocean Striped Bass Commercial Gear Permit so that fishermen may have additional time to decide about their participation in these fisheries.
D. This proclamation supersedes Proclamation M-37-2013, dated November 22, 2013. This proclamation confirms the Marine Fisheries Commission’s approval of the suspension of the portion of N.C. Marine Fisheries Commission Rule 15A NCAC 03O .0501(f) identified in Section I.
