PROCLAMATION

RE: COBIA-COMMERCIAL CLOSURE- RECREATIONAL SIZE AND CREEL LIMITS-TEMPORARY RULE SUSPENSION


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 12:01A.M., Thursday, December11, 2014, the following restrictions will apply to the cobiafishery:

I. SUSPENSION OF N.C. MARINE FISHERIES COMMISSION RULE 15A NCAC 03M .0516
N.C. Marine Fisheries Commission Rule 15A NCAC 03M. 0516 is suspended in its entirety.

II. COMMERCIAL CLOSURE
It is unlawful to possess, sell or offer for sell,cobia taken in a commercial fishing operation.

III. RECREATIONAL SIZE AND CREEL LIMITS

A. It is unlawful to possess cobia less than 33 inches fork length.

B. It is unlawful to possess more than two (2) cobia per person per day.

IV.GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G. S. 113-170.4; 113-170.5; 113-182; 113- 221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103, and 03M .0512.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. The intent of this proclamation is to implement the new federal closure of the commercial cobia fishery and to clarify the recreational creel and size limits. For more information on the commercial fishery closure, please see http://sero.nmfs.noaa.gov/fishery_bulletins/documents/pdfs/2014/fb14-092_sa_comm_cobia_closure.pdf.

D. For the purpose of this commercial closure, a commercial operation is not allowed to retain a recreational limit of cobia.

F. This proclamation closes the commercial cobia fishery and clarifies recreational size and creel limits.
