PROCLAMATION
RE: TEMPORARY SUSPENSION OF RULE – AMERICAN EEL
Dr. Louis B. Daniel III Director, Division of Marine Fisheries, hereby announces that effective at 12:01 A.M. Wednesday, January 1, 2014, the following provisions shall apply to North Carolina Marine Fisheries Commission Rule:
I. TEMPORARY SUSPENSION
North Carolina Marine Fisheries Commission Rule 15A NCAC 03M .0510 is suspended in its entirety.
II. HARVEST RESTRICTIONS
A. It is unlawful to possess, sell or take American eels less than nine (9) inches in total length.
B. It is unlawful to possess more than 25 American eels per person per day for recreational purposes.
C. It is unlawful to possess American eels from September 1 through December 31 unless taken by baited pots.
III. GENERAL INFORMATION
A. This proclamation is issued under the authority of N.C.G. S. 113-134; 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103 and 03M .0512.
B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. The intent of this proclamation is to suspend the size and possession limits for American eels and replace them with new ones effective January 1, 2014 in compliance with Addendum III of the Atlantic States Marine Fisheries Commission American Eel Fishery Management Plan provisions. This suspension will be in place until a complementary rule is developed by the N.C. Marine Fisheries Commission.
