PROCLAMATION

RE: TEMPORARY SUSPENSION OF RULE, HARVEST RESTRICTIONS – AMERICAN EEL


Dr. Louis B. Daniel III Director, Division of Marine Fisheries, hereby announces that effective at 12:01 A.M. Friday, May 1, 2015, the following restrictions implemented by proclamation FF-71-2014 for the American eel fishery are rescinded:

I. Temporary Suspension
North Carolina Marine Fisheries Commission Rule 15A NCAC 03M .0510 is suspended in its entirety.

II. Harvest Restrictions

A. It is unlawful to possess, sell or take American eels less than nine (9) inches in total length.

B. It is unlawful to possess more than 25 American eels per person per day for recreational purposes.

C. It is unlawful to possess American eels from September 1 through December 31 unless taken by baited pots.

III. GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G. S. 113-134; 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103, 03I .0102 and 03M .0512.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. The intent of this proclamation is to rescind FF-71-2014 in order to manage the American eel fishery in accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03M .0510.

D. In accordance with Addendum I to the Atlantic States Marine Fisheries Commission Interstate Fishery Management Plan for American Eel, participation in the eel logbook program is a mandatory requirement for Standard Commercial Fisherman License (SCFL) holders who use eel pots to harvest American eel. General Statute 113-170.3 (a) requires SCFL holders to participate in DMF record-keeping requirements: “licensees may be required to keep additional information of a statistical nature or relating to location of catch as may be needed to determine conservation policy.” For more information about the eel logbook program contact Jason Rock at 252-946-6481 or 800-338-7804.

E. In accordance with N.C. General Statute 113-221.1(c) All persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

G. FF-71-2014 is being rescinded effective 12:01 A.M., May 1, 2015, in order to manage the American eel fishery in accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03M .0510.
