PROCLAMATION

RE: SPINY DOGFISH — RESCINDED - DEALER PERMIT AND REPORTING REQUIREMENTS

Proclamation FF-60-2016 is being rescinded effective 12:01 A.M., Monday, May 1, 2017 in order to manage the Spiny Dogfish Dealer Permit in accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03O .0503 (b)(6). Permit requirements have not changed with the exception that the requirement is now in permanent rule and not implemented by Proclamation. All 2017 Spiny Dogfish Dealer Permits previously issued are valid for the remainder of the calendar year. The rule makes it unlawful for a fish dealer to purchase or possess more than 100 pounds of spiny dogfish per day per commercial fishing operation unless the dealer has a Spiny Dogfish Dealer Permit.

Braxton C. Davis, Director, Division of Marine Fisheries, hereby announces that effective at 12:01 A.M. Monday, May 1, 2017, the following restrictions implemented by Proclamation FF-60-2016 that applied to the commercial spiny dogfish fishery are rescinded:

I. PERMITS
It is unlawful for finfish dealers to purchase more than 100 pounds of spiny dogfish sharks per day per commercial fishing operation unless the dealer has a valid 2017 Spiny Dogfish Dealer Permit from the North Carolina Division of Marine Fisheries. Permits will be issued only to those licensed fish dealers holding a valid license as authorized in G.S. 113-169.3.

II. PERMIT CONDITIONS
It is unlawful for finfish dealers in possession of a 2017 Spiny Dogfish Dealer Permit to fail to abide by all permit conditions in N.C. Marine Fisheries Commission Rules 15A NCAC 3O .0502 and .0503 (b) (1), and others as listed on the 2017 Spiny Dogfish Dealer Permit.

III. GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G.S.113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103, 03O. 0506 and 03M .0512.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. N.C. Marine Fisheries Commission Rule 15A NCAC 03I .0113 specifies that it is unlawful for any licensee under Chapter 113, Subchapter IV of the General Statutes to refuse to allow the Fisheries Director or his agents to obtain biological data, harvest information, or other statistical data necessary or useful to the conservation and management of marine and estuarine resources from fish in the licensee’s possession.

D. In accordance with N.C. General Statute 113-221.1(c) All persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

F. The intent of this proclamation is to continue the requirement for a dealer permit and a reporting process for the taking of spiny dogfish sharks from the Atlantic Ocean and North Carolina estuarine waters. This is to assure that the annual quota (May-April) established by the Atlantic States Marine Fisheries Commission is not exceeded.

G. Spiny Dogfish Dealer Permits are available at no cost from all Division of Marine Fisheries License Offices.

H. Proclamation FF-60-2016 is being rescinded effective 12:01 A.M., Monday, May 1, 2017 in order to manage the Spiny Dogfish Dealer Permit in accordance with N.C.
