PROCLAMATION

RE: ESTUARINE STRIPED BASS- CENTRAL SOUTHERN MANAGEMENT AREA INTERNAL COASTAL FISHING WATERS- CLOSED SEASON RECREATIONAL


This proclamation supersedes proclamation FF-38-2018, dated September 27, 2018. This proclamation prohibits the possession of striped bass (including hybrids) by closing the recreational fishing season in the Internal Coastal Fishing Waters of the Central Southern Management Area. This action complies with Supplement A to Amendment 1 to the North Carolina Estuarine Striped Bass Fishery Management Plan.

Stephen W. Murphey, Director, Division of Marine Fisheries, hereby announces that effective at 12:01 A.M., Monday, March 11, 2019 the Season to Harvest Striped Bass Taken for Recreational Purposes WILL CLOSE in portions of the Striped Bass Central Southern Management Area (CSMA) as described and the following restrictions will apply:

I. AREA DESCRIPTION (See Section IV (F). for rule prohibiting possession in the Cape Fear River and its tributaries)

A. Area A includes Internal Coastal Fishing Waters for Tar-Pamlico and Neuse rivers and other Internal Coastal Fishing Waters of the Central Southern Management Area as described in rule 15NCAC 03R .0201, Excluding all Joint Fishing Waters of the Central Southern Management Area and the Joint and Coastal Fishing Waters of the Cape Fear River and tributaries (including Snow’s Cut). (MAP A.)

B. Area B includes Joint Fishing Waters for Tar-Pamlico and Neuse rivers and other Joint Fishing Waters of the Central Southern Management Area as described in rule 15NCAC 03R .0201, Excluding the Joint and Coastal Fishing Waters of the Cape Fear River and tributaries (including Snow’s Cut).  (MAP B.)

II. RESTRICTIONS AREA A.

A. It is unlawful to possess striped bass.

B. It is unlawful to fail to return all striped bass to the water in a manner that ensures the highest likelihood of survival.

III. RESTRICTIONS AREA B. (See Section IV (H) for Size and other restrictions in rule)

A. Daily Creel Limits
1. It is unlawful to possess more than two (2) striped bass taken in any one day by hook and line or for recreational purposes.
B. Season, Means, and Methods
1. Striped bass may be taken by hook and line or for recreational purposes seven days a week during the open season.
2. The recreational season for striped bass closes at 11:59 P.M. on Tuesday, April 30, 2019.
3. It is unlawful to sell, offer for sale, or purchase striped bass taken by hook-and-line or for recreational purposes.

IV. GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52; and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103, 03M .0202, and 03M .0512.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. In accordance with N.C. General Statute 113-221.1(c) All persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. N.C. Marine Fisheries Commission Rule 15A NCAC 03M .0201 defines striped bass as striped bass and its hybrids.

E. The intent of this proclamation is to prohibit possession of striped bass in the Internal Coastal Fishing Waters of the Central Southern Management Area, excluding all Joint Fishing Waters in the Central Southern Management Area and Joint and Coastal fishing waters of the Cape Fear River and tributaries (including Snow’s Cut) in accordance with Supplement A to Amendment 1 to the North Carolina Estuarine Striped Bass Fishery Management Plan. The Supplement was adopted by the Marine Fisheries Commission on February 22, 2019 to protect important year classes of striped bass while Amendment 2 to the N. C. Estuarine Striped Bass Fishery Management Plan is being developed.

F. N.C. Marine Fisheries Commission Rules 15A NCAC 03M .0202 and 15A NCAC 03Q .0107 state that it is unlawful to possess striped bass from the Coastal and Joint Fishing Waters of the Cape Fear River and its tributaries, including Snow’s Cut (Cape Fear River Map).

G. N.C. Wildlife Resources Commission Rule 15A NCAC 10C .0314 states that in the Inland fishing waters of the Central Southern Management Area the minimum size limit is 26 inches (total length) with a daily creel limit of two (2) striped bass. H. N.C. Marine Fisheries Commission Rule 15A NCAC 03Q .0107 states for Joint Fishing Waters of the Central Southern Management Area:
1. It is unlawful to possess striped bass between the lengths of 22 and 27 inches (total length);
2. It is unlawful to possess any striped bass or striped bass hybrid that is less than 18 inches long (total length).
3. It is unlawful to possess more than one daily creel limit of striped bass or striped bass hybrids, in the aggregate, per person per day, regardless of the number of management areas fished
4. Possession of fish shall be assessed for the creel and size limits of the management area in which the individual is found to be fishing, regardless of the size or creel limits for other management areas visited by that individual in a given day
I. N.C. Wildlife Resources Commission Rule 15A NCAC 10C .0314 states that in the Inland Fishing Waters of the Cape Fear River and its tributaries downstream of Buckhorn Dam, the season for taking and possessing striped bass is closed year-round.

J. See Proclamation M-5-2019 for commercial gear restrictions. The commercial striped bass harvest season remains closed (FF-6-2018).

This action complies with Supplement A to Amendment 1 to the North Carolina Estuarine Striped Bass Fishery Management Plan.
