RE: MECHANICAL HARVEST OF CLAMS
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 7:30 A.M. on Thursday, January 31, 2013, the following area will temporarily open to the harvest of clams by mechanical means:
I. AREA: CARTERET COUNTY
Core Creek Area — All public bottoms in the maintained cut of the Intracoastal Waterway in Core Creek from the Highway 101 high rise bridge south to Marker “19” and from the True World Marine dock south to the southern end of the prohibited area approximately 350 yards south of Marker “21". Eastman Creek and Bell Creek will remain CLOSED to mechanical harvest of clams.
II. HARVEST LIMITS:
Harvest will be allowed from 7:30 A.M. to 4:00 P.M. Mondays through Fridays. A maximum daily harvest limit of 8,750 clams (35 bags at 250 clams per bag) in possession will be allowed per fishing operation from Thursday, January 31, 2013 until the area is closed by rainfall or proclamation. The minimum size limit will apply. No mechanical harvesting shall take place within 25 feet of private piers, bridge fenders or seawalls.
III. GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103 and 03K .0301 and .0302.
B. It is unlawful to violate the provisions of any proclamations issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule15A NCAC 03H .0103.
C. This is a temporary opening based on current biological conditions and will close when the area is closed again for the protection of public health.
