PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that effective immediately:

The closure description text for (5) (f) and Map 5, (6) (a), (6) (b) and Map 6, (14) (a) and Map 14, (47) (c) and Map 47, and (50) (a) and Map 50 in this proclamation supersedes those specific closure descriptions and Maps for PA-PC-2013 dated June 27, 2013. The following changes are technical revisions to closure description text and map text and do not result in any additional closures:

No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted area:

(5) CROATAN SOUND AREA (MAP 5)

(f) Wanchese – All those waters near the south end of Roanoke Island north, east and west of a line beginning at a point 35º 49.5841' N -75º 36.9817' W; running southerly to a point 35° 49.5540’ N -75° 36.9714’ W; running southerly to a point 35° 49.2893’ N -75° 37.0334’ W on Marsh Island; running southwesterly to a point 35° 49.0805’ N -75° 37.5293’ W; running northwesterly to a point 35° 49.3831’ N -75° 39.1520’ W on the marsh; running northwesterly to a point 35° 50.2342’ N -75° 39.4936’ W at the Baum Creek closure line.

(6) ROANOKE SOUND AREA (MAP 6)

(a) Shallowbag Bay – All those waters in Shallowbag Bay and its tributaries southwest of a straight line beginning at a point 35° 55.1566’ N -75° 39.5686’ W on Baum Point; running southeasterly to a point 35° 54.6041’ N -75° 38.8488’ W on Ballast Point.

(b) Roanoke Sound Area – All those waters within a line beginning at the south side of the mouth of Broad Creek at a point 35° 50.6807’ N -75° 37.1362’ W; running northeasterly to a point 35° 50.8473’ N -75° 36.9090’ W in the sound; running southeasterly to a point 35° 50.5999’ N -75° 36.7475’ W in the sound; running southerly to a point 35° 49.8815’ N -75° 36.7543’ W in the sound; running westerly 35° 49.8863’ N -75° 37.0581’ W on the shore to include Mills Creek and its tributaries.

(14) PUNGO RIVER AREA (MAP 14)

(a) Jordan Creek – All those waters in Jordan Creek upstream of a line beginning at a point 35° 27.3589’ N -76° 36.4293’ W on the southwest shore; running northeasterly to a point 35° 27.4490’ N -76° 36.3077’ W; running northerly to a point 35º 27.7203' N -76º 36.2171' W on the northeast shore.

(47) CAPE FEAR RIVER AND SOUTHPORT AREA (MAP 47)

(c) Wildlife Boat Ramp – All those waters near the Wildlife Boat Ramp at Fort Fisher beginning at a point 33º 57.5417' N -77º 56.5334' W on the shore west of the ramp; running southerly to a point 33º 57.5152' N -77º 56.5344' W; running southeasterly to a point 33º 57.4916' N -77º 56.4878' W; running northerly to a point 33º 57.5205' N -77º 56.4853' W on the shore east of the ramp.

(50) CALABASH AREA (
MAP 50)

(a) Calabash Area – All those waters bordered on the east by a line beginning at a point 33° 54.0464’ N – 78° 25.0944’ W on the north shore of the IWW; running southerly near IWW Channel Marker “89” to a point 33° 53.9412’ N – 78° 25.0617’ W on the south shore; bordered on the south by a line beginning on Ocean Isle Beach near Tubbs Inlet at 33° 52.7335’ N -78° 28.2302’ W; running northerly to a point on the north shore at 33° 52.7522’ N -78° 28.2492’ W; thence running northerly following the shoreline of the marsh to a point at 33° 52.8874’ N -78° 28.3058’ W; thence across the creek in a northerly direction to a point at 33° 52.9132’ N -78° 28.3169’ W; thence following the marsh to a point at 33° 52.9576’ N -78° 28.7068’ W; thence northerly across the creek to a point at 33° 52.9921’ N -78° 28.7241’ W; thence to a point on marsh at Still Creek at 33° 52.9851’ N -78° 28.7561’ W; thence running southwesterly across the creek to a point at 33° 52.9215’ N -78° 28.8016’ W; thence following the marsh around Tubbs Inlet to a point on the east shore of Jinks Creek at 33° 52.7393’ N -78° 29.6339’ W; running southwesterly across the creek to a point on the west shore at 33° 52.6729’ N -78° 29.6735’ W; thence following the marsh on the southwest side of Jinks Creek to a point at 33° 52.6684’ N -78° 29.6631’ W; running southerly to a point at 33º 52.6552' N -78º 29.6445' W; thence continuing to follow the marsh on the southwest side of Jinks Creek to a point on the north shore of a creek at 33° 52.5640’ N -78° 29.5747’ W; running southerly across the creek to a point on the south shore at 33° 52.5541’ N -78° 29.5733’ W; thence running southerly following the marsh to a point on the north shore of the Sunset Beach Canals at 33° 52.5445’ N -78° 29.5858’ W; running southerly to a point on the south shore at 33° 52.4767’ N -78° 29.5839’ W; and bordered on the west by a line beginning on the north shore of the IWW near Calabash at 33° 52.0295’ N -78° 33.5711’ W; running southerly across the IWW to a point on the south shore of the IWW at 33° 52.0122’ N -78° 33.5508’ W; thence following the marsh running in a southerly direction to a point at 33° 51.9606’ N -78° 33.4892’ W; thence to a point at 33° 51.5913’ N -78° 33.0552’ W; thence running southerly to a point on Bird Island at 33° 51.2132’ N -78° 32.6100’ W on the North Carolina / South Carolina state line.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
 
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
 
C. This Proclamation supersedes the following portions of Proclamation PA-PC-2013 dated June 27, 2013 and does not result in any openings or closures: (5) (f) and Map 5, (6) (a), (6) (b) and Map 6, (14) (a) and Map 14, (47) (c) and Map 47 and (50) (a) and Map 50.
