RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Sunday, December 22, 2013.
All those waters in Carteret County will return to the status in existence immediately prior to the November 27, December 3, and December 15, 2013, temporary closures except the following which will remain closed:
Hoop Pole Creek - All those waters in the Hoop Pole Creek area upstream of a line beginning on a point of marsh at 34°42.4519’ N -76°45.1967’ W; running southeasterly across the bay to a point of marsh at 34°42.4429’ N -76°45.1829’ W; running southeasterly following the shoreline to a point at 34°42.4069’ N -76°45.1285’ W; running southeasterly across the creek to a point 34°42.3984’ N -76°45.1098’ W on the eastern shore.
Newport River - All those waters upstream of a line beginning near Penn Point on the south shore at a point 34° 45.6960' N - 76° 43.5180' W running NE to a point on the north shore near Hardesty Farms subdivision 34° 46.5733' N - 76° 42.6350' W. (DMF Shrimp Line).
Nelson Bay - All those waters in NelsonBay upstream of a line from Drum Point to the northern tip of Fulchers Creek.
The following also remains closed:
All those waters in Pamlico Sound 200 yards offshore of Hatteras Island between a point 200 yards north of the north drain at Rodanthe and a point 200 yards south of the south drain at Rodanthe.
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This proclamation returns the following areas to normal closure boundaries: a portion of NewportRiver and North River.
D. These reopenings are due to satisfactory bacteriological sampling results.
