Working with EEP’s In-Lieu Fee Programs

One purpose of EEP is to provide a mitigation service to the private and public entities that may need assistance in meeting state and federal compensatory-mitigation regulations.  Developers, agencies, and other applicants who wish to participate in one of EEP's voluntary In-Lieu Fee (ILF) mitigation programs, contact and work with the EEP Asset Management & Reporting Section’s ILF Program coordinators.  NCDOT agency personnel work with EEP’s NCDOT Coordinator; all other applicants work with EEP’s Statewide ILF Coordinator. 

EEP's ILF programs provide a consistent, convenient and streamlined approach for developers and others to address stream, wetland, riparian buffer and/or nutrient compensatory mitigation requirements.

EEP offers four ILF mitigation programs which the public and private sectors may access on a voluntary basis. Through the ILF programs, permittees (such as government entities, the military and other public institutions, as well as eligible small businesses, non-profits and private developers) can transfer responsibility for compensatory mitigation requirements associated with permitted, unavoidable environmental impacts to the EEP.  Participation in the ILF programs significantly simplifies the compensatory mitigation process for the permittee.
