At its November 2008 meeting, the CRC:
Adopted amendments to 15A NCAC 7H .1401, .1402, .1404, .1405 General Permit for Construction of Groins in Estuarine & Public Trust Waters, which would allow materials other than wood, and clarify how structures are measured. Adopted amendments to 15A NCAC 7H .2101, .2102, .2104, .2105 General Permit for Marsh Enhancement Breakwaters, to ensure consistency with other shoreline stabilization rules. Adopted amendments to 15A NCAC 7H .2401, .2402, .2404, .2405 General Permit for Placement of Riprap for Wetland Protection, which include changes to the dimensions and geometry of structures. Adopted amendments to 15A NCAC 7J .0701 Variance Petitions, which would require claimants to file either a variance request or a contested case, but not pursue both options at once. Adopted amendments to 15A NCAC 7J .0703 Variance Petitions, which would outline procedures for situations where both parties cannot come to a decision due to an inability to come to a decision on stipulated facts. Adopted amendments to 15A NCAC 7M .0301, .0302, .0303, .0306, .0307 Shorefront Access Policies, which would establish a reporting requirements for user fees collected at state access sites, and includes provisions to utilize funds outside of the current funding cycle in order to capitalize on unique opportunities. Adopted amendments to 15A NCAC 7B .0901 CAMA Land Use Plan Amendments and 7B .0801 Public Hearing and Local Adoption Requirements, in order to strengthen the linkages between the plan amendment section and the LUP review and certification sections of the rules. On the recommendation of the Coastal Resources Advisory Council, certified a Land Use Plan for the Town of Pine Knoll Shores. On the recommendation of the Coastal Resources Advisory Council, approved a Land Use Plan Amendment for the Town of Carolina Beach. Voted to accept DCM staff’s recommendation for the updated Inlet Hazard Area boundary for Bald Head Island. Approved an Implementation and Enforcement Plan for the Town of Holly Ridge. The plan allows the town to act as the local permit-letting authority for activities related to minor development within Areas of Environmental Concern. Approved an amendment to the Implementation and Enforcement Plan for the Town of Cape Carteret. Denied a variance to Leland D. Egland of Onslow County, who sought relief from the Commission’s oceanfront setback rules in order to construct single family home in North Topsail Beach. Granted a variance to Bogue Watch, LLC of Carteret County, who sought relief from the Commission’s specific use standards for estuarine shorelines in order to dredge a navigation channel that would impact a small section of Primary Nursery Area. Approved the Coastal Habitat Protection Plan Annual Report.
