REQUEST MITIGATION

Customers interested in submitting a request to EEP to provide mitigation for unavoidable impacts from development projects can choose from the request forms below.

Note that all requests to access the EEP's In-Lieu Fee programs must be accompanied by a signed Compliance Form (included in the "Make a Request" links below) verifying knowledge of and compliance with Session Law 2009-337 and Session Law 2011-343, which restrict use of EEP's ILF programs for some entities when credits are available from mitigation-banking companies.

In response to questions received by both the N.C. Division of Water Quality and EEP, DWQ has provided guidance to clarify the acceptability of using EEP’s ILF programs for buffer mitigation and/or nutrient offsets to satisfy local government requirements that go beyond those found in state rules or legislation. To help with the clarification, several scenarios are provided to illustrate the suitability for local governments to direct developers to EEP’s ILF programs.
